2026 FEDERAL UNIVERSAL SERVICE FUND ANNUAL CERTIFICATE

The customer identified above (“Customer”) submits this annual certification in support of its request for waiver of Federal Universal Service Fund (“FUSF”) surcharges. The application of FUSF Surcharges by Whisl Telecom, LLC (WHISL) will be based upon representations and information provided by the Customer in all portions of this certification form, as well as information available on the Federal Communications Commission (“FCC”) FCC Form 499 Filer Database.


FUSF exemption Forms not returned to the Company will generate FUSF charges to WHISL ’s customers


CUSTOMER’S FORM 499 INFORMATION: 

Customer (or its affiliate identified below) has filed and will continue to file the FCC Form 499-A reports and if applicable the FCC Form 499-Q reports using the following FCC 499 Filer ID#: (6-digit number beginning with “8”)

I. CUSTOMER IS EXEMPT FROM WHISL FUSF CHARGES

Customer is entitled to an exemption from WHISL FUSF charges and related charges for WHISL services that it purchases, because at least one of the following applies:

A. DIRECT CONTRIBUTOR: Customer identified by the FCC Form 499 Filer ID provided above, purchases the Services for resale and contributes directly to the FUSF in accordance with FCC rules. Customer is responsible for reporting and remitting all applicable FUSF contributions associated with revenues derived from offerings that incorporate the purchased Services.
B. RESELLER: The customer identified by the 499 Filer ID provided above, offers services exclusively to resellers. Either directly contributes or has a reasonable expectation that another entity in the chain of resellers directly contributes to the federal universal service support mechanisms and maintains documentation supporting the contributors’ USF obligations.
C. INTERNATIONAL TRAFFIC ONLY: Customer purchases services solely for non-U.S.–originating and non-U.S.–terminating traffic, (does not originate or terminate traffic to the U.S. Public Switched Telephone Network (PSTN)). Accordingly, such Services are not subject to FUSF assessment.
D. NON-USF-CONTRIBUTABLE SERVICES: Customer is not purchasing any FUSF assessable WHISL services (e.g., customer is only purchasing intrastate or other non-telecom services).

Please note that pursuant to FCC requirements, in order to qualify for the exemption under Part 1.(A), Customer must be designated a USF contributor on the FCC Enforcement Bureau’s website. Customer is solely responsible for ensuring that its status on the FCC Enforcement Bureau’s website is correctly identified.


If you marked box 1(B) above, by signing the form below you are additionally certifying to the following statement:  


“I certify under penalty of perjury that the company is purchasing service(s) for resale, at least in part, and that the company is incorporating the purchased services into its own offerings which are, at least in part, assessable U.S. telecommunications or interconnected Voice over Internet Protocol services. I also certify under penalty of perjury that the company either directly contributes or has a reasonable expectation that another entity in the downstream chain of resellers directly contributes to the federal universal service support mechanisms on the assessable portion of revenues from offerings that incorporate the purchased services.”

II. CUSTOMER IS NOT EXEMPT FROM WHISL FUSF CHARGES

Customer is not entitled to an exemption from WHISL FUSF charges and related charges for WHISL services that it purchases, because the following applies:
DE MINIMIS FILER: Customer certifies that it qualifies as a “de minimis” filer under FCC rules (i.e., its annual Federal Universal Service Fund contribution obligation is less than $10,000) and therefore does not directly contribute to the Universal Service Fund. Customer agrees to notify WHISL within thirty (30) days of any change in its FCC Form 499 filing status or USF contribution status.

III. CERTIFICATION

The undersigned is duly authorized by Customer to execute this Form and to make the representations, attestations and/or certifications on Customer’s behalf:


The Customer understands that WHISL is acting is reliance on the representations contained in this certification Form and, under the penalty of perjury that they are true and accurate.


The Customer has a continuing obligation to maintain the accuracy of the representations above and no later than fifteen (15) calendar days of any change; Customer will update the Certifications Form and will provide the updated forms to WHISL at the email address at the top of this form.


The individual name below is authorized by the Customer to make this certification on its behalf. The undersigned authorized representative certifies that all statements above are true and accurate.


If the information provided by Customer in the certification form is false, WHISL reserves the right to pursue all remedies including without limitation, imposing applicable FUSF charges, late-payments interest and/or penalties.
